REQUIREMENTS FOR THE REGISTRATION OF TRADEMARKS, SERVICE MARKS, SLOGANS AND OTHER DISTINCTIVE SIGNS

To apply for a trademark, service mark, slogan or trade name, the following documents and information are required:

  • Power of Attorney, duly legalized by Apostille or nearest Honduran Consulate;
  • Extract of Articles of Incorporation or Certificate of Good Standing, duly legalized by Apostille or nearest Honduran Consulate;
  • When marks incorporate a design or illustration, 25 labels of the design or illustration;
  • International class or classes in which the trademark will be registered and the description of goods or services covered by the mark; and,
  • Description of the Design in case of illustrated marks.
  • Certified Priority Application (if claiming Paris Convention priority);

When filing applications for advertising signs or slogans, the application must indicate the mark or commercial name with which the slogan will be used. The mark or commercial name may be a part of the slogan only when they have been registered by the same applicant.

REQUIREMENTS FOR THE RECORDAL OF ASSIGNMENTS, MERGERS AND NAME CHANGES

To record an assignment, merger or change of name, the following documents and information are required:

  • Assignment, merger or change of name, duly legalized by Apostille or nearest Honduran Consulate;
  • Power of Attorney granted by new owner , duly legalized by Apostille or nearest Honduran Consulate.

REQUIREMENTS FOR PATENT REGISTRATION

  • Name and address of the Inventor;
  • Power of Attorney, duly legalized by Apostille or nearest Honduran Consulate;
  • Extract of Articles of Incorporation or Certificate of Good Standing, duly legalized by Apostille or nearest Honduran Consulate;
  • Certified Copy of the Priority Application;
  • DESCRIPTION of the Patent;
  • CLAIMS:
  • SUMMARY;
  • DRAWINGS (if any).

REQUIREMENTS FOR NATIONAL PHASE ENTRY FOR PCT PATENT APPLICATIONS

  • Copy of PCT Form RO/101*;
  • Power of Attorney, duly legalized by Apostille or nearest Honduran Consulate;
  • Extract of Articles of Incorporation or Certificate of Good Standing, duly legalized by Apostille or nearest Honduran Consulate;
  • Assignment from Inventors, duly legalized
  • DESCRIPTION of the Patent*;
  • CLAIMS*;
  • SUMMARY*;
  • DRAWINGS (if any)*.
  • *Documents must be filed in Spanish to meet national Phase Deadline

FOOD HEALTH REGISTRATION REQUIREMENTS

  • Power of Attorney (duly legalized or Apostilled)
  • Certificate of Good Standing or Articles of Incorporation (legalized or Apostilled).
  • Labels of primary and secondary packages which must contain:
    1. Product name
    2. Name and address of owner
    3. Name and address of distributor
    4. Country of origin
    5. List of ingredients
    6. Batch number
    7. Date of expiration
    8. Net content
    9. Health registration number.
    10. Labels must be in Spanish.
  • Free Sale Certificate from country of Origin (must include expiration date) duly legalized or Apostilled.
  • Distributor’s Valid Sanitary License
